TERMS AND CONDITIONS

1. ORGANIZER

The Miami International Arts & Music Youth Festival (“MIAMY Festival” or “the Festival”) is organized by Miami International Arts & Music Youth Festival, Inc. and Musicall, Inc., a non-profit 501(c)(3) organizations registered in the State of Florida, with principal offices located in Miami-Dade County.

2. ELIGIBILITY

The Festival is open to youth ensembles, orchestras, choirs, and individual performers between the ages of 8 and 27. Groups must be composed primarily of young performers who meet the age requirement at the time of the festival. Each ensemble must have an official adult representative (conductor, director, or responsible chaperone).

3. REGISTRATION & PAYMENT TERMS

  • All registrations must be submitted through the official Festival registration platform or via email confirmation with an official MIAMY Festival representative.

  • Upon acceptance, a non-refundable registration fee of $250.00 is due within 30 days to secure participation.

  • The final payment for all festival-related fees (performance fees, workshops, accommodations, meals, etc.) must be made no later than 90 days prior to the start of the Festival.

  • Late payments may result in forfeiture of participation rights without refund.

4. CANCELLATIONS & REFUNDS

  • Cancellations must be submitted in writing and are subject to the following refund policy:

    • More than 120 days before the Festival: 50% of fees (excluding the registration fee) will be refunded.

    • 90–120 days before the Festival: 25% refund (excluding the registration fee).

    • Less than 90 days before the Festival: No refunds will be issued.

  • In the event of force majeure (natural disasters, public health emergencies, acts of terrorism, etc.), the Festival may cancel or postpone the event. In such cases, the Organizer will make reasonable efforts to reschedule. Fees may be partially refunded or credited toward a future edition, at the Organizer’s discretion.

5. PERFORMANCE RIGHTS & MEDIA RELEASE

By participating in the Festival, all ensembles and individuals grant MIAMY Festival and Musicall, Inc.:

  • The unrestricted right to photograph, film, record, or livestream performances and related events.

  • The right to use such media in print, online, and social media for promotional and archival purposes without further compensation.

  • The right to use the name, image, and likeness of participants for promotional use, in accordance with Florida law.

Participants waive any claims against MIAMY Festival, Musicall, Inc., or its partners for the use of such media.

6. PROGRAM CONTENT & APPROVAL

All repertoire and performance content must be pre-approved by the Festival’s Artistic Committee. Content must be appropriate for youth audiences and meet the standards of artistic quality promoted by the Festival. The Organizer reserves the right to request changes to the program.

7. LIABILITY & INSURANCE

  • Participants are responsible for securing their own travel, health, and instrument insurance.

  • Musicall, Inc. and the MIAMY Festival are not liable for personal injuries, lost or stolen property, or damage incurred during the event.

  • Ensembles and individual participants are required to comply with all local, state, and federal laws and with the rules of the venues and accommodations.

8. ACCOMMODATIONS & TRAVEL

Participants are responsible for their own travel arrangements. The Organizer may recommend or assist with group travel and accommodations but is not liable for delays, cancellations, or issues arising from third-party providers.

9. CODE OF CONDUCT

All participants are expected to uphold the highest standards of behavior. This includes:

  • Respect for fellow performers, staff, audiences, and property.

  • Adherence to schedules and rehearsals.

  • Compliance with all safety guidelines and local regulations.

Violations of the code of conduct may result in removal from the Festival without refund.

10. DISPUTE RESOLUTION

Any disputes or claims related to participation in the MIAMY Festival will be governed by the laws of the State of Florida. Venue for any legal action will be in Miami-Dade County, Florida. Parties agree to seek informal resolution before pursuing legal remedies.

11. PRIVACY POLICY

Information collected through registration will be used solely for Festival administration and communications. MIAMY Festival will not share personal data with third parties except as required for Festival operations or by law.

12. MODIFICATION OF TERMS

The Organizer reserves the right to amend these Terms and Conditions at any time. Registered participants will be notified in writing of any significant changes.
